WAIVER

BIKING, BIKE TRACK, & PROPERTY ACCESS HOLD-HARMESS, Release of Liability & Agreement NOT TO SUE. PLEASE READ CAREFULLY BEFORE SIGNING. You cannot alter this release document. Acceptance of this agreement constitutes a contract. The conditions of this contract are set forth below and will prevent your ability to sue GRAVITYSOUL LLC, Its officers, OLD HARMONY FARM, LLC, and the owners or leaseholders of The property at 4125 Coxey Brown Rd. Myersville, MD. If you do not agree with these conditions then DO NOT attend or take part in any event or activity managed by GRAVITYSOUL LLC, OLD HARMONY FARM, LLC, or Events or activities that take place on the property at 4125 Coxey Brown Rd., Myersville, MD.

I understand and am aware that operating, riding, racing, and just being in close proximity to a moving Bike is a Hazardous and Dangerous Activity. I understand that operating and riding Bikes involves a risk of serious bodily injury and/or death. I, on behalf of myself, my children, heirs, executors, or assigns, hereby freely and expressly assume and accept responsibility for any and all risks of injury or death while participating or spectating in this activity regardless of any negligence of GRAVITYSOUL LLC and OLD HARMONY FARM, LLC, it’s officers, agents, or employees as well as the owners or leaseholders of the property at 4125 Coxey Brown, Rd., Myersville, MD. I understand that there are dangers and inherent and other risks involved in biking and other attendant activities.

The risks include but are not limited to:

  • Variations in the steepness and condition of the trail, features, or property surfaces

  • The chance of collision with another biker or pedestrian

  • The chance of collision with fixed and/or movable objects (natural and man-made)

  • Muddy, icy, loose, greasy, or slippery surface conditions

  • Logs, rocks, sticks, holes, and other debris both on and off of track surfaces

  • Failure of or damage to existing track and trail features, natural and man-made

  • Mechanical failure of bikes and biking equipment including flat tires

  • Stinging and biting insects and other wildlife encountered

  • Allergic reactions to plants encountered

  • Variable surface conditions due to changing temperatures and weather conditions

I understand and agree that it is my sole responsibility to view and inspect the biking area BEFORE I participate and to NOT participate if the area or adjacent areas or conditions are not to my satisfaction. I will not engage in careless or reckless behavior that might endanger others. I am not and will not participate in activities while under the influence of drugs, alcohol, or prescription medications that may affect my ability to safely operate a bike under all conditions. I represent that there is nothing preventing my ability to control myself and operate a bike if I so choose. I agree that if any portion of this agreement is found to be void or unenforceable the remaining portions shall remain in full force and effect.

I understand I may be photographed at this event or activity. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers, and their assigns.

I have read the above Contract and Release of Liability Agreement and fully understand it. I understand that riding, racing, or spectating at bike events is a purely voluntary act and has serious dangers and inherent risks involved. I understand that I have the right to refuse this release agreement and NOT participate. I understand that participating in GRAVITYSOUL LLC bike activities or events at OLD HARMONY FARM, LLC, 4125 Coxey Brown Rd., Myersville, MD is contingent upon signing this release. I recognize that I am free to NOT participate and can reject this Release from Liability and/or reject it on behalf of my minor children. All the above considered I have voluntarily chosen to agree and sign it.
